I worked with Andrea Kyle.

We entered into a buyer agreement on August 17th 2024. I sent her several homes from redfin, she arrived 30minutes late for our scheduled appointments to provide showings. The first home on 3591 Cameo Drive was my choice. We provided an offer.

I asked if we could increase the sales price to have the seller pay for me to get out my lease and on August 21, 2024 Andrea yelled at me on a recorded line stating I was giving her inconsistent information from leasing office in which I live. I knew from this point on her unprofessional behavior would risk the transaction. However since I signed the agreement I choose to find a working solution. I explained that while the leasing office was verbally inconsistent I would go in person for clarity and reach out to the manager for a written contract to review terms. Andrea chose to provide the listing agreement with the amount it would cost to break the lease prior to reviewing the contract which created confusion. I did not appreciate her sharing that information at that time since we did not have the leasing agreement contract yet.

She did not tell me the counter offer was due August 22, 2024 at 2pm. The listing agent however did on a recorded causing the seller to go with the other offer.

Her aggressive behavior afterwards with yelling, choice words and derogatory language has created severe emotional distress which is causing heightened therapy bills. I cannot sleep at night knowing I am tied to this brokerage as they have refused to sign a cancellation buyer agreement form now three times.
1. The original buyer cancellation agreement form had unfavorable contingencies. Your sales director Gill agreed and had Andrea send a new form.

2. The second buyer cancellation form was not signed and had a prospective buyer agreement attached.

3. The third buyer cancellation form had no prospective buyer agreement but was not signed.

Now they are completely unresponsive.

DO NOT WORK WITH THIS REALTOR OR BROKERAGE !!!

This is to inform you that due to Seller and  Listing Agent's failure to disclose concerning the Solar Panels, we the Buyers plan to move forward to file a complaint with the Board of Brokers and California DRE. The complaint to be filed is against Performance Real Estate, their Listing Agent Andrew Lewis of Performance Real Estate, and the Seller Jennifer Wilson.

We will also be filing a complaint against Performance Realty Brokerage company Jason Lopez California Brooker of Record.

Though the seller fail to disclose it was your job (Andrew Lewis) as the Selling Agent to make sure all information provided by your client to us was accurate and correct.
